Adjudication of Show cause notice – Petitioner submits notice issued is beyond advance ruling given in favour by appellate authority – Department submits 5% discount given by Petitioner to owner is a supply of service to be taxed accordingly – HELD: Writ petition disposed – Whether notice seeks to do something which is also ruled upon in Advance Ruling order, or something that authorities will have to decide while adjudicating notice. Further what tax to be paid and at what rate, will also to be decided whilst adjudicating notice – Petitioner shall file its reply to notice within four weeks and notice shall be adjudicated within twelve weeks.
